Justice for 11-week old baby that died after 20 jabs in one visit

Anna Sims, an 11-week-old healthy, breastfed infant who was developing normally—cooing, smiling, and rolling over—died on December 16, 2013, less than eight hours after receiving four routine vaccines (Pediarix, Hib, PCV13, and RotaTeq) during her two-month well-baby visit. Her father, Daniel Sims, a stay-at-home dad caring for her and her two brothers, noticed her becoming unusually quiet and “spaced out” after the appointment.

Around 5 p.m., after feeding and burping her, he placed her in her bassinet; 20 minutes later, he found her with bluish lips and barely breathing. He rushed her to the hospital in a six-minute drive, but she was pronounced dead at 7:15 p.m. The family’s grief was profound. Mother Abigail Sims shared on the Circle of Mamas website in April 2025: “My beautiful daughter was only alive for 10 weeks and 6 days. She was so healthy until she died 6 hours after receiving her vaccinations. My heart is aching constantly, but until recently, I have kept quiet.”

She expressed frustration over the lack of recognition for vaccine-related deaths, noting that when she mentions the timing, people often dismiss it, forcing her to explain that “it was the only possible cause of death as everything else was ruled out.”

Abigail also criticized systemic issues: “Vaccine manufacturers have NO liability for injuries or deaths caused by vaccines… The ethics violations are deadly.”

Medically, the autopsy and expert analyses attributed Anna’s death to vaccine-induced encephalopathy, potentially involving pulmonary edema and visceral congestion. Findings included brain swelling causing cerebral edema, brainstem herniation, and cardiopulmonary failure from an immune reaction triggered by the vaccines.

Neuropathologist and child neurologist Dr. Robert Shuman provided key evidence, stating that clinical symptoms and pathological findings supported acute encephalopathy. Immunologist Dr. M. Eric Gershwin affirmed this as a plausible mechanism. Government experts initially suggested sudden infant death syndrome (SIDS) or sudden unexplained infant death syndrome (SUID), but their own specialist admitted the autopsy wasn’t thorough enough to rule out other causes and acknowledged the brain edema, without proving an unrelated origin.

Legally, the Sims family filed a petition with the National Vaccine Injury Compensation Program (VICP) in 2015, arguing an “off-table injury” that required proving causation by a preponderance of evidence using medical records and expert testimony. The case dragged on for nearly a decade, typical for such proceedings under the 1986 Childhood Vaccine Injury Act, which shields manufacturers from liability and funds payouts via a 75-cent excise tax per vaccine dose.

In June 2025, a special master ruled in their favor—the first infant death compensation from VICP in over a decade—awarding $300,000 ($250,000 death benefit plus $50,000 for Anna’s pain and suffering).

The U.S. Department of Justice (representing HHS) tried to overturn it, but the U.S. Court of Federal Claims denied review in March 2024. HHS did not appeal, finalizing the settlement in August 2025. Additional costs included over $428,000 for the family’s attorneys and experts, with undisclosed expenses for government lawyers.

The family views this as a potential model for future cases, highlighting the challenges of navigating the no-fault system without judges, juries, or standard evidence rules.
